                                ORDINANCE NO. 9708
                  
                  
                   AN ORDINANCE TO AMEND PART II, CHATTANOOGA
                   CITY CODE, CHAPTER 18, ARTICLE VIII, SO AS
                   TO PROVIDE A NEW SECTION ESTABLISHING A
                   CIVIL PENALTY OF UP TO FIVE HUNDRED AND
                   NO/100 DOLLARS ($500.00) FOR VIOLATION OF
                   THE ANTI-LITTER CODE OF THE CITY AND BY
                   STRIKING PENALTY PROVISIONS OF SECTION
                   18-170 OF SAID CHAPTER.
                  
                                                    
                  
                  
       	    	 SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
       CITY OF CHATTANOOGA, TENNESSEE, That Part II, Chattanooga City
       Code, Chapter 18, Article VIII, be and is hereby amended by 
adding
       thereto a new section to provide as follows:
           "Sec. 18-177.  Penalty for violation.
          
            	 Violations of this article shall be punishable by
            civil penalty of up to Five Hundred Dollars ($500.00)
            for each violation and each day any violation of this
            article continues shall constitute a separate offense."
           
       	    	 SECTION 2.  BE IT FURTHER ORDAINED, That Section 18-170
       of Part II, Chattanooga City Code, be and is hereby amended by
       striking therefrom the last two sentences thereof.
       	    	 SECTION 3.  BE IT FURTHER ORDAINED, That this Ordinance
       shall take effect two (2) weeks from and after its passage, as
       provided by law.
